{"id":31,"date":"2017-02-05T04:51:08","date_gmt":"2017-02-05T04:51:08","guid":{"rendered":"https:\/\/hrnetsourcedemo.com\/blog\/?p=31"},"modified":"2017-02-18T20:52:46","modified_gmt":"2017-02-18T20:52:46","slug":"six-common-hr-mistakes-that-lead-to-litigation-2","status":"publish","type":"post","link":"https:\/\/hrnetsourcedemo.com\/blog\/2017\/02\/05\/six-common-hr-mistakes-that-lead-to-litigation-2\/","title":{"rendered":"Six Common HR Mistakes That Lead to Litigation, part 2"},"content":{"rendered":"<p style=\"text-align: center;\">See <a href=\"https:\/\/hrnetsourcedemo.com\/blog\/2017\/02\/05\/six-common-hr-mistakes-that-lead-to-litigation\/\">part 1<\/a><\/p>\n<p>In my last blog, I listed the top three mistakes that Ernie Malaspina talked about in a recent presentation to HR professionals.\u00a0 Here are the remaining three of his \u201cDirty Half-Dozen\u201d:<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Mistake #4.\u00a0\u00a0\u00a0 Failing to compensate employees for all hours or days of work<br \/>\n<\/strong><\/p>\n<p>An important starting point is to properly identify each employee\u2019s compensable day and\/or hours of work.\u00a0 With today\u2019s digital economy, it is not uncommon to see employees spend time sending or receiving emails <u>outside normal business hours<\/u>.\u00a0 Is that compensable?\u00a0 What about working remotely from home after hours?\u00a0 What about holiday shutdowns?\u00a0 Many employers fail to consider the effect of a shutdown on their wage payment obligations before finalizing their plans.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>How to avoid these mistakes:<\/strong><\/p>\n<ol>\n<li>Some laws have not kept up with changing times. Understand and accept that \u201cthe law\u201d and modern business customs are sometimes incompatible.\u00a0 But \u201cit\u2019s the law\u201d and it can be costly <u>not<\/u> to comply.\u00a0\u00a0 If the law needs to change, wait until the law is actually changed.<\/li>\n<li>Consider restricting non-exempt employees\u2019 access to email outside normal business hours.<\/li>\n<li>Do not allow managers to create a culture in which employees are expected to work without pay.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><strong>Mistake #5.\u00a0\u00a0\u00a0 Poor Documentation of Performance Problems and Misconduct<\/strong><\/p>\n<p>The saying, \u201cDocument, document, document\u201d cannot be overemphasized, since decisions based on an employee\u2019s performance or misconduct are vulnerable to challenge.\u00a0 A discharged employee may contend that the decision was based on race, gender, age, disability or religion, for example and deny that they have performed poorly.\u00a0\u00a0 Misconduct not only needs to be documented, but also handled consistently especially if it leads to termination.\u00a0\u00a0 The employee may deny engaging in the misconduct at all, or may claim that the behavior has been tolerated in the past.<\/p>\n<p>While documentation is good, care must also be taken on the exact words used in the documentation, as these can also be used against the employer.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>How to avoid these mistakes:<\/strong><\/p>\n<ol>\n<li>Document poor performance and misconduct as it occurs.\u00a0 Include description of the incident, date, and full names of persons involved.<\/li>\n<li>Check with legal counsel when documenting misconduct that could be characterized as discrimination or harassment. The wrong language may be construed as admission of liability if the complaining employee asserts a claim.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><strong>Mistake #6.\u00a0\u00a0\u00a0 Conducting the Termination Improperly<\/strong><\/p>\n<p>The decision to terminate employment is the decision that most often leads to lawsuits.\u00a0 Sometimes companies inadvertently provoke litigation by how they deliver the message, which can trigger feelings of anger or humiliation.\u00a0 Other employers increase their risk of liability when they make unnecessary statements about terminated employees such as mentioning that the employee left involuntarily, the reason for the decision, and other circumstances of their departure.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>How to avoid these mistakes:<br \/>\n<\/strong><\/p>\n<ol>\n<li>Treat the employee with dignity and respect. Conduct the termination meeting privately.<\/li>\n<li>Minimize discussion of the reasons for the termination decision. What you say can and will be used against you in a court of law. \u00a0Some companies have two persons present so one can serve as a witness to the conversation.<\/li>\n<li>Use discretion when speaking about former employees after termination.
